As a full-time realtor, I’ve seen many buyers get excited about rental income potential, only to later realize the basement apartment doesn’t meet city requirements. And when that happens, the cost is on the buyer — not the seller.
🔍 1. Legal, Retrofit, or Personal Use – What’s the Difference?
Not all finished basements are created equal:
- A legal basement unit is registered with the city and complies with building, fire, and zoning codes.
- A retrofit basement may meet fire code but might still not be legal as a rental suite.
- A personal use basement can’t legally be rented out — even if it has a kitchen and separate entrance.
Tips: 📌 Always verify legal status through the city — don’t rely only on listing details or verbal claims.
🧾 2. Read Schedule B — It’s in the Fine Print
Many offers include a Schedule B clause saying: “Seller does not warrant the retrofit status of the basement apartment.”
If you sign this, you’re accepting the risk — the seller is not responsible, even if bylaws are being violated.
🔥 3. Legal Basement Units Must Have…
To be legal, most municipalities require:
- Proper fire-rated construction and egress
- Working smoke and CO detectors
- Adequate ceiling height
- Separate entrance
- Zoning compliance and possibly a dedicated parking spot
Don’t be fooled by a nice renovation — compliance matters more than cosmetics.

If there’s any doubt:
- Call the city’s zoning or building department
- Ask for permits or second-dwelling registration documents
- Have your lawyer review the title and zoning use
